Sale regulation

1. Preliminary remarks
All the business relationships between Ge.Ma.R srl and customers are regulated by the following general sales conditions, different conditions will be agreed in written form.

2. Responsibility
Ge.Ma.R srl is not responsible for any damage or loss, direct or indirect, for the sale of products or services offered on the web site catalogue (www.campaniadamare.it), and also for delayed or missed delivery, neither for the specification published on the web site nor for any other event directly ascribed to Ge.Ma.R srl.

3. Technical information
All the technical information reported on our web site are obtained from the producers’ published information. Ge.Ma.R srl, thereby, reserves the right to amend or adjust the technical and size information of the catalogue products on the basis of what will be provided by the producers, also with no notice.

4. Orders
The purchase orders are only accepted in written form, or by fax, or through the web site.
Once the customer place an order on line, at the end of the process, will get a confirmation order, with the relevant order number. This confirmation can also be provided by email. In case, after the order, does not appear (after few minutes) the order number, the purchase will not be considered accepted, as by law enacted.

5. Prices
All the displayed priced on the web site are valid for cash payment. During the updating time, there can be some changes in the prices. Prices are VAT excluded.

6. Shipment and Delivery
Shipments, except different agreements between the parties, will be executed by the arranged transport company. If the transport company is appointed by the client, Ge.Ma.R srl will not be responsible for any loss and/or damage of the product until the goods are delivered to its own warehouse.
Time and cost delivery, merely indicative, are published on the apposite section.

7. Risk and Property
Goods are shipped carriage free, insured with charge on invoice; in case goods are shipped carriage forward, upon client’s approval, the risk is on charge of the client from the delivery of the goods in its warehouse to the carrier.
When the goods are delivered, the client should check the package integrity and the quantitative and qualitative correspondence with what is reported on the waybill.
In case of variation, this should be reported on the same waybill and confirmed, within seven days and sent by fax or registered mail with signed return receipt, to your account sales manager.
Also in case of undamaged package, you should carefully check the goods. Any hidden anomaly, should be reported in written form and sent by fax or registered mail with signed return receipt within seven days from the date of receipt.
Any recommendation beyond the above mentioned terms, will not be considered valid. For any declaration, the client is fully responsible of what he declares.

8. Payments
All the supplied goods should be paid in cash or in anticipated credit transfer, except for any different written agreed conditions with Ge.Ma.R srl.
Ge.Ma.R srl. reserves the right, to his unquestionable judgement, to not carry out the shipment of the goods, also after the order acceptance, to those clients that have exceeded the bank credit, with expired payments or under dispute.

9. Right to cancel the orders
The client can ask to cancel the order or part of it, Ge.Ma.R srl reserves the right to accept the cancellation of it. The cancellation request (and acceptance of it) shall be made by fax or email, and will be accepted only if the goods ordered expressly for the client, are still not delivered by the supplier.

10. Right of withdrawal
Following the Article 5of 185/1999 the consumer can withdraw from it without any explanation and penalties, but must send a notice by registered letter with receipt within 10 days from receipt of goods.

11. Goods return
The return of the goods to Ge.Ma.R srl, shall be requested by fax or email to your sales account manager stating the reason for the goods return request, quoting the invoice number and/or the waybill and shall be clearly authorized by fax or email. The return of the goods shall be done prior authorization and on line assignment of the “return number” within seven working days from the goods return request date.
The goods to be returned, shall be in perfect conditions, in the original package and shipped carriage free to our warehouse, quoting, on the document, the return number assigned. We will not accept partial returns. The customer will be responsible for the product until it reaches ns. warehouse, breakage will be against him. The GE.MA.R. reimburse the client the amount paid for the purchase of goods within 30 days from the return of the same. Refund will be made by bank transfer, the Buyer shall provide his bank details.

12. Guaranties
The purchase of goods at Ge.Ma.R srl involves the full acceptation of the guaranty conditions provided by the producer. The client is therefore aware that the purchased goods will be guaranteed by the producer and at the same conditions applied by him, and accepts, wholeheartedly, all the producer’s performance guarantee, also with reference, for instance, to the subject manager of the warrant, even if different.

13. Data protection policy

In accordance with the Leg. Decree 196/2003, the client accepts that the personal information provided and/or exchanged, also in pre contractual level, will be threaten in accordance with the Leg. Decree 196/2003, for effect and the intention of the art.24, comma 1, lett. b) and following changes of the Leg. Decree 196/2003.
It is clear that the client expressly agrees to the personal information treatment in accordance with the Leg. Decree 196/2003 and also to its communication and diffusion.

14. Dispute

For any possible rising dispute the Court of Salerno will be the place of jurisdiction. Unless requested otherwise the consumer

15. Conditions
The conditions on this document can be modified, with no notice and will be valid from the publishing date on the web site  www.campaniadamare.it
